Article 1 \u2013 Purpose<\/h2>\n

These terms and conditions govern sales made by Caf\u00e9 Morgane Inc.<\/p>\n

Article 2 \u2013 Prices<\/h2>\n

The prices of our products are indicated in Canadian dollars, with GST and QST applied where applicable, unless otherwise stated. Processing and shipping fees are not included.<\/p>\n

When an order is shipped to a country other than Canada, you are considered the importer of the product or products concerned. Customs duties, local taxes, import duties, or state taxes may be payable. These duties and amounts are not the responsibility of Caf\u00e9 Morgane. They are your sole responsibility, including all declarations and payments required by the relevant authorities and organizations in your country. We recommend contacting your local authorities for more information.<\/p>\n

All orders, regardless of their origin, must be paid for in Canadian dollars.<\/p>\n

Caf\u00e9 Morgane reserves the right to modify its prices at any time. However, products will be invoiced at the price in effect when the order is confirmed, subject to availability.<\/p>\n

Products remain the property of Caf\u00e9 Morgane until full payment has been received. Please note that once you take physical possession of the products ordered, the risk of loss or damage is transferred to you.<\/p>\n

Article 3 \u2013 Orders<\/h2>\n

Contractual information is presented in French and will be confirmed no later than the time your order is finalized.<\/p>\n

Caf\u00e9 Morgane reserves the right not to process a payment or confirm an order for any reason, particularly in the event of supply issues or difficulties concerning the order received.<\/p>\n

Article 4 \u2013 Order Confirmation<\/h2>\n

Any order placed through the website www.cafemorgane.com<\/a> constitutes acceptance of these Terms and Conditions. Confirming an order constitutes your full and complete acceptance of these Terms and Conditions of Sale, without exception or reservation.<\/p>\n

All information provided and the recorded confirmation will constitute proof of the transaction. You acknowledge that you are fully aware of this.<\/p>\n

The order confirmation will constitute your signature and acceptance of the transactions completed.<\/p>\n

Article 5 \u2013 Payment<\/h2>\n

By confirming your order, you agree to pay the indicated price.<\/p>\n

Purchases must be paid for by credit card through a secure payment platform.<\/p>\n

The full amount of the order is charged when the order is confirmed. If certain products cannot be shipped, the corresponding amount will be refunded using the original payment method.<\/p>\n

Article 6 \u2013 Returns and Refunds<\/h2>\n

Return Policy<\/h3>\n

Coffee products cannot be refunded or exchanged once the bags have been opened. These products are final sale.<\/p>\n

Accessories may be exchanged, provided that they have not been used or altered.<\/p>\n

The product must be returned in its original packaging.<\/p>\n

Returns must be made within 10 days of the purchase date.<\/p>\n

Initial delivery fees are non-refundable. The customer is responsible for the costs associated with returning the product.<\/p>\n

For all returns, please contact the head office by email to submit a return request. Please indicate the reason for the return on your invoice. When a return is authorized, reasonable return shipping costs will be reimbursed upon presentation of proof of payment. The refund will be issued using the original payment method. Returns may also be made in person at one of our caf\u00e9s.<\/p>\n

We reserve the right to refuse returns that do not comply with our return policy. Exchanges cannot be processed online. You will need to place a new order.<\/p>\n

Refund Policy<\/h3>\n

Sale merchandise is final sale. No refunds will be accepted.<\/p>\n

Shipping fees are non-refundable.<\/p>\n

All returned merchandise will be inspected before a refund can be authorized. Once the return has been approved, the refund will be processed as soon as possible using the original payment method. The time required for the refund to appear may vary depending on the financial institution.<\/p>\n

Article 7 \u2013 Availability<\/h2>\n

Our products are available as long as they are displayed on www.cafemorgane.com<\/a> and while supplies last. Products that are not kept in stock are offered subject to availability from our suppliers.<\/p>\n

Should a product become unavailable after you have placed your order, we will notify you by email. Your order will automatically be cancelled, and you will receive a refund.<\/p>\n

Article 8 \u2013 Delivery<\/h2>\n

Products are delivered to the shipping address provided during the ordering process, within the timeframe indicated on the order confirmation page.<\/p>\n

In the event of a shipping delay, you will receive an email informing you of any potential impact on the delivery timeframe originally provided.<\/p>\n

When deliveries are handled by a carrier, Caf\u00e9 Morgane cannot be held responsible for delays caused exclusively by the customer\u2019s unavailability after several delivery attempts or appointment proposals.<\/p>\n

Delivery Policy<\/h3>\n

A flat delivery fee of $10 applies to purchases under $75 within Qu\u00e9bec.<\/p>\n

For deliveries elsewhere in Canada, a $15 delivery fee applies to purchases of $75 or less.<\/p>\n

We reserve the right to modify shipping fees without prior notice.<\/p>\n

In-store pickup is available.<\/p>\n

Orders are generally processed within 48 to 72 business hours. Delivery times may then vary depending on the destination, the carrier, and circumstances beyond our control. A tracking number will be sent to you by email once your order has been transferred to the carrier.<\/p>\n

We deliver within Canada only.<\/p>\n

Article 9 \u2013 Warranty<\/h2>\n

All our products are covered by the legal warranty of conformity and the warranty against latent defects provided for under Articles 1641 and following of the Civil Code. A product that does not conform may be exchanged.<\/p>\n

Any claim or exchange request must be submitted by email to info@cafemorgane.ca<\/a> within 30 days following delivery of the order.<\/p>\n

Products must be returned in the condition in which they were received, together with all included components, such as accessories, packaging, and instructions. Initial shipping fees will be refunded based on the amount invoiced, and return shipping fees will be reimbursed upon presentation of supporting documentation.<\/p>\n

Article 10 \u2013 Liability<\/h2>\n

The products offered comply with current Canadian legislation. Caf\u00e9 Morgane cannot be held liable for failure to comply with the legislation of the country to which a product is delivered. It is your responsibility to check with local authorities regarding the importation or use of the products or services you intend to order.<\/p>\n

Caf\u00e9 Morgane cannot be held responsible for damages resulting from the improper use of a purchased product.<\/p>\n

Finally, Caf\u00e9 Morgane cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusions, or computer viruses.<\/p>\n

Article 11 \u2013 Governing Law and Disputes<\/h2>\n

The language of this agreement is French. These Terms and Conditions of Sale are governed by French law. In the event of a dispute, Canadian courts will have exclusive jurisdiction.<\/p>\n

Article 12 \u2013 Intellectual Property<\/h2>\n

All elements of the website www.cafemorgane.com<\/a> are and remain the exclusive intellectual property of Caf\u00e9 Morgane Inc.<\/p>\n

No person is authorized to reproduce, exploit, redistribute, or use any element of the website, in whole or in part, including its software, visual, or audio content.<\/p>\n

Any direct or hypertext link to the website is strictly prohibited without the prior express written consent of Caf\u00e9 Morgane Inc.<\/p>\n
